Indian-annexation of Kashmir, is incompatible with international law and the Indian Constitution.
Once again, we express our deep concern about the worsening situation in Jammu and Kashmir. Since New Delhi eliminated its special status of autonomy, effective for 72 years, on last August 5, 2019, and not content with that, President Modi intends now the total annexation of Jammu and Kashmir as federal territory of India. Another open human rights violation and of all current treaties and resolutions of the UN Security Council and India’s own commitments to implement UNSC resolutions.
The recent action of the Indian government, aim to change the identity and demographic composition of the occupied territories of Jammu and Kashmir and transform it from a Muslim majority state to a Hindu majority territory.
We remind the president Modi that he must act according to the law, and should fulfill with the recent statement of the UN Secretary General, which stated that the UN position on the issue of Jammu and Kashmir is governed by the UN Charter and the successive resolutions of the Security Council. Since August 5, India decided to eliminate unilaterally and unknowingly, in an action that constitutes an attack against its own Constitution, the special status of Jammu and Kashmir, that have been under total blockade. Since then, the Indian government has blocked the access to communications and imposed restrictions of movement in a way of stop any protest in the region.
Several international observers and activists, human rights groups, including Human Rights Watch and Amnesty International, UN, have repeatedly asked India to lift the restrictions and release political detainees, to what India stated that, «93% of the restrictions have been alleviated in the region» in conflict, statements that have been unverifiable by independent groups and territory organizations.

We urge India to rescind and repeal its unilateral illegal actions, to stop its human rights violations in the occupied territories (https://www.majdi.org/human-rights-violations-in-jammu-and-kashmir-report/) including the use of force against peaceful protesters and the withdrawal of its strong military presence.
We denounce once again the confinement of the people of Kashmir, the 24-hour curfew and the detention of thousands of people, including leaders, academics, students and children.
The demand for justice of the people of Kashmir must be heard and their opinion must be widely consulted; Their constitutional, human and humanitarian rights must be respected. Its annexation as federal territory, not only does not leads to a true solution, but also exacerbates the conflict in South Asia and beyond, territory for which two wars have already occurred.
The lasting peace, stability and security that New Delhi says to look for, will only be achieved through respect for the people and territorial integrity of Jammu and Kashmir.
